2. ELIGIBILITY

• You must be at least 18 years of age and legally competent under the Indian Contract Act, 1872 to use the Services.
• If you access or use the Services on behalf of a business or entity, you represent and warrant that you are duly authorized to bind such entity to these Terms.

3. SERVICES PROVIDED

• We provide indicative property valuation reports, tools, analytics, and related support derived from algorithms, public records, market data, and third-party sources.
• Reports are informational only and do not constitute legal, financial, tax, investment, or real estate brokerage/agency advice under the Real Estate (Regulation and Development) Act, 2016 (RERA) or any other law.
• The Company is not a broker, intermediary, investment adviser, or fiduciary. Users should obtain independent professional advice as necessary.
• No warranty or guarantee is provided regarding exact market value, sale price, future appreciation, or investment outcomes of any property.

4. COMPANY'S RIGHT TO REFUSE OR WITHDRAW SERVICES

• We may refuse, suspend, or terminate Services at our sole discretion without assigning reasons. Where Services are denied after payment but before delivery, we will refund only the actual service fee paid.
• Refunds, where permitted, are limited strictly to the service fee charged. We shall not be liable for opportunity costs, reliance damages, business interruption, or market fluctuations.

5. USER OBLIGATIONS

You agree that you shall not:

• Provide false, incomplete, misleading, or deceptive property details or documents.
• Reverse engineer, copy, distribute, or resell any part of the Services or Platform content.
• Upload or transmit illegal, offensive, defamatory, infringing, or harmful content or code.
• Manipulate valuation outcomes, interfere with systems, or engage in fraudulent activity.
• Use the Platform in violation of any applicable law, regulation, or third-party rights.

6. PAYMENTS & FEES

• Access to certain portions of the Platform may be free; valuation reports and premium tools are chargeable.
• All payments must be made through our approved payment gateways. We do not store payment card or bank details.
• Fees once paid are non-refundable except as expressly permitted under these Terms (see Sections 4 and 14).

7. USER CONSENT BEFORE SUBMISSION

1. Finality of Submission: By submitting property details for valuation, you confirm that all information (including property type, location, size, ownership, encumbrances, and supporting documents) is true, complete, and accurate to the best of your knowledge. Once submitted, such details cannot be modified, edited, or replaced.
2. Automated Valuation Consent: You acknowledge and consent that the valuation process is automated and may rely on algorithms, publicly available data, third‑party databases, and integrations, with limited human intervention.
3. No Refund After Submission: Upon submission of property details, the valuation process shall be deemed initiated. Consequently, no refund or cancellation shall be permitted thereafter, irrespective of any subsequent request, change in circumstances, or correction sought by you (see also Section 14).
4. Responsibility for Accuracy: You bear sole responsibility for the correctness and completeness of all data and documents submitted. The Company shall not be liable for any loss, delay, or consequence arising from incorrect, outdated, or incomplete information provided by you.
5. Binding Consent: By checking the consent box and/or clicking "Submit Property Details," you provide express, informed consent to initiate the valuation under these conditions and agree to be bound by Sections 7 and 14.

8. DATA & SECURITY

• Transactions are processed via PCI-DSS compliant third-party gateways; we do not store your payment credentials.
• Data handling is governed by our Privacy Policy available on the Platform.

9. INTELLECTUAL PROPERTY

• All algorithms, reports, content, interfaces, tools, and software on the Platform are proprietary toSWACH INFOTECH PRIVATE LIMITED and/or its licensors.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or internal business purposes only.
• Any unauthorized reproduction, modification, distribution, public display, or resale is prohibited.

10. DISCLAIMER OF WARRANTIES

• The Platform and Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
• Indicative valuations are estimates only and should not be the sole basis for financial, legal, or transactional decisions.
• We do not warrant uninterrupted, timely, secure, or error-free Services, nor the accuracy, completeness, or reliability of any output or content.

11. LIMITATION OF LIABILITY

• To the fullest extent permitted by law, the Company, its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including without limitation loss of profits, goodwill, opportunity, data, or business interruption.
• Without prejudice to the foregoing, the Company's aggregate liability, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the actual service fee paid by you for the specific Service giving rise to the claim.
• You acknowledge that Sections 7, 10, 11, and 14 are fundamental allocations of risk that form the basis of the bargain between you and the Company.

12. INDEMNITY

You agree to indemnify, defend, and hold harmless SWACH INFOTECH PRIVATE LIMITED, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, losses, damages, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use or misuse of the Platform or Services;
• Your breach of these Terms, applicable laws, or third‑party rights; or
• Any inaccuracy or omission in information or documents submitted by you.

13. TERMINATION

• We may suspend or terminate access to the Platform or any part of the Services immediately if you breach these Terms or if required by law or regulatory directive.
• You may discontinue use of the Services at any time. Termination shall not affect obligations accrued prior to termination, including payment obligations and the applicability of Sections 7, 10–12, 14–16.

14. CANCELLATION & REFUND POLICY

• Given the digital and automated nature of valuation, all purchases are final and non‑refundable once the valuation process is initiated pursuant to Section 7.
• Refunds may only be considered if: (i) the Company refuses Service after accepting payment (see Section 4); or (ii) a proven technical failure, attributable solely to the Company, prevents delivery of the report.
• Where applicable, approved refunds will be processed to the original payment method within a reasonable period (typically 7–10 working days), subject to banking timelines.

15. FORCE MAJEURE

We shall not be liable for any delay or failure in performance due to causes beyond our reasonable control, including acts of God, natural disasters, epidemics, strikes, labor disputes, internet or telecom failures, power outages, cyber‑attacks, governmental actions, or similar events.

16. GOVERNING LAW & DISPUTE RESOLUTION

• These Terms shall be governed by and construed in accordance with the laws of India.
• Parties shall first attempt to resolve disputes amicably within 30 days of written notice.
• Unresolved disputes shall be referred to arbitration in accordance with the Arbitration & Conciliation Act, 1996, by a sole arbitrator appointed by the Company.
• The seat and venue of arbitration shall be Hyderabad. The proceedings shall be conducted in English.
• Subject to the foregoing, the courts at Hyderabad, Telangana shall have exclusive jurisdiction.

17. CHANGES TO TERMS

We reserve the right to modify or update these Terms at any time without prior notice. Updates will be posted on the Platform, and continued use of the Platform after such updates shall constitute acceptance of the revised Terms.
